. The cause was noticed by the
Defendants for the Circuit on the 27th. in Batavia.
I have not much confidence the cause will be
tried and think it more than probable it will be referred.
but as we must be ready I will send you this week a
Subpoena. It will not be necessary should the cause be
tried for you to go to Batavia until you are notified by
telegraph of the day the case will be tried
If you will advise me of your return and as to the prob-
ability of your being able to attend at Batavia I
shall be very much obliged
