cause be continued to the next term
of said court for hearing and argument
without prejudice to either party.

My dear Uncle:
Above you have a copy of
the stipulation in Silsby's case: Mr Blatchford
on the eve of his departure for Rochester re-
quested me to send it to you and to say that
it was his opinion that the case could
not, according to the stipulation, be called
for argument at the sitting of the court
in April. The stipulation postpones the

case to the "next term" of the court, that is to
a new term; and therefore, the session in April,
being but a prolongation of the last term,
cannot, with propriety, be called the "next
term" contemplated by the stipulation:
If Mr Foote should insist upon having
the case go over to the next term we do
not see that the stipulation would
authorize us to bring it on:
